Obtaining a Certificate of Occupancy (C of O) is one of the most technically demanding and consequential milestones in any construction or renovation project. It is the final gate between a completed building and lawful occupancy — and navigating it requires far more than a simple application. JMI's in-house team brings more than 20 years of direct experience managing every dimension of the C of O process across Washington DC, Maryland, and Northern Virginia.

We analyze building approval documents to determine the correct application type, prepare submissions, coordinate all required inspections, manage inter-agency approvals, and when necessary, advocate directly with code officials for conditional or phased occupancy — so your project crosses the finish line on schedule.

Understanding Your Certificate of Occupancy

Not every project receives a standard full C of O. Determining the right type — and executing the correct strategy to obtain it — requires deep knowledge of the DC Department of Buildings approval process, zoning code, and building code use classifications.

Type 1

Full Certificate of Occupancy

Issued when all building code use classifications, zoning conditions, and life safety requirements have been fully satisfied. JMI manages the complete documentation package, final inspections, and clearance of all DOB review flags to secure a permanent Full C of O.

Type 2

Partial Certificate of Occupancy

Allows occupancy of a specific floor, suite, or portion of a building while construction continues elsewhere. JMI analyzes the approved permit package to determine which spaces qualify and prepares phased C of O submissions to enable early occupancy of completed portions.

Type 3

Conditional Certificate of Occupancy

Issued when minor outstanding items remain, allowing temporary occupancy subject to specific conditions and a compliance timeline. Securing a Conditional C of O requires identifying eligible deficiencies, preparing a persuasive code compliance argument, and advocating directly with the responsible DOB code official to gain approval.

Our Certificate of Occupancy Process

1

Document Analysis & Strategy

We review the full building permit approval package — including zoning conditions, PUD stipulations, construction code modifications, and prior C of O history — to determine the correct C of O type and identify any outstanding compliance requirements before submission.

2

Zoning Condition Review

Many building permit approvals carry zoning conditions that must be satisfied prior to C of O application — including required dedications, public benefits, signage, or use restrictions. We audit the full approval history to ensure all conditions are documented and met before submission.

3

Preliminary Oversight Inspections

Before the DOB Life Safety Oversight Inspection, our team performs a thorough preliminary walkthrough of the building against the approved construction documents and DOB inspection checklist — identifying and resolving deficiencies in advance to maximize the probability of passing on the first inspection.

4

Third-Party Inspection Coordination

We coordinate directly with the project's third-party Special Inspection Agency and Building Inspector to ensure all required inspection reports, structural observation letters, and material testing documentation are compiled, formatted correctly, and submitted to DOB on time.

5

Closeout Agency Coordination

C of O issuance depends on clearances from multiple agencies. We coordinate directly with DOEE for SWM and Green Area Ratio (GAR) closeout, DOB for Green Building and Fire/Structural review closure, and any other required agency sign-offs before the final application is submitted.

6

Submission, Notarization & Advocacy

Our team prepares, notarizes, and submits all required C of O application documents. Where complex use classifications, code interpretation questions, or conditional approval strategies are required, we advocate directly with DOB code officials — including preparing formal code interpretation letters when necessary.

Agency Closeout Coordination

A Certificate of Occupancy cannot be issued until clearances are obtained from multiple DC agencies. JMI manages all inter-agency coordination so nothing falls through the cracks at the most critical point of your project.

DC Department of Buildings (DOB)

Life Safety Oversight Inspections, Green Building compliance, Fire Review, Structural Review closeout, and final C of O issuance coordination.

DOEE — Stormwater & Green Area Ratio

Coordination of Stormwater Management (SWM) plan compliance and Green Area Ratio (GAR) verification required for C of O clearance on qualifying projects.

Third-Party Building Code & Special Inspection Agencies

Coordination with the project's third-party building code inspectors and special inspection agencies for missing documentation submission and project impasse resolution with DOB to keep the C of O process moving.

Architect & Engineering Design Team

Coordination with the project's Architect of Record and engineers on construction document close-out, as-built submissions, and any required design team certifications.

DC Office of Zoning

Verification of PUD conditions, BZA conditions, and zoning administrator interpretations that must be documented and satisfied prior to C of O application.

20+ Years of In-House C of O Expertise

The Certificate of Occupancy process is the most consequential — and often most unpredictable — phase of a development project. Delays at this stage translate directly to lost revenue, missed lease commencement dates, and mounting carrying costs.

JMI's in-house team has guided dozens of projects through every variation of the C of O process: straightforward new construction, complex multi-phase developments, disputed use classifications, historic structures, mixed-use buildings with multiple independent occupancies, and projects requiring code modification and conditional approval strategies.

We don't outsource this work and we don't rely on generalist permit runners. Every C of O engagement is handled by experienced professionals who know the DC DOB process, know the code, and know how to navigate the situations that others can't.
